A company’s Employee Handbook provides that all employees who have worked 1250 hours in the preceding 12 months are entitled to FMLA leave. An employee who satisfied those conditions applies for leave. The company denies leave on the grounds, as provided by the Act, that the employee did not work at a location within 75 miles of a company facility having 50 or more employees. The employee files suit for wrongful denial of FMLA leave under an implied contract theory.
The issue is: Can an employee handbook obligate an employer to provide FMLA leavethat it would not otherwise be required to furnish?
